Operator and Agreement
PokeLoupe is operated by Jones Collectibles LLC, a South Dakota limited liability company. In these Terms, PokeLoupe, we, us, and our refer to Jones Collectibles LLC.
These Terms form an agreement between you and Jones Collectibles LLC. Questions and legal notices about the Service can be sent to support@pokeloupe.com.

What PokeLoupe Does
PokeLoupe provides software tools for inspecting Pokemon TCG marketplace listings before you decide whether to buy on a marketplace, reject, favorite, or add a card to My Feed.
The Service may show eBay listings, marketplace price references, sold-market data, listing photos, listing metadata, seller context, centering overlays, perspective tools, favorite listings, rejected listings, hidden seller rules, and My Feed cards.
PokeLoupe does not buy, sell, broker, authenticate, grade, appraise, warehouse, insure, ship, or fulfill cards on your behalf.
PokeLoupe does not place bids, submit offers, complete purchases, or perform marketplace account actions on your behalf.

Your Account
Some features require an account. You are responsible for your account credentials and for activity performed through your account.
You must be at least 18 years old to create an account or use the Service.

Subscriptions and Billing
PokeLoupe may offer free and paid subscription tiers. When checkout identifies Link as the seller, the subscription is sold through Link by Stripe under Stripe Managed Payments, where Link acts as merchant of record. Other subscriptions are processed through Stripe Billing. Paid subscriptions renew until canceled, and legacy or complimentary subscriptions may remain managed directly through Stripe Billing.
New PokeLoupe Pro subscriptions do not include an introductory free trial. The first recurring charge is due when checkout completes unless the checkout page expressly states a different billing date. A legacy subscription that is already in a Stripe trialing state may retain access through its existing trial period, but PokeLoupe does not create new introductory trials.
Prices, included limits, billing periods, any applicable tax, transaction currency, and the amount due are shown at checkout. Managed Payments customers can manage transactions and subscriptions through Link; other subscriptions use the PokeLoupe billing page and Stripe portal. Cancellation stops future renewal. Refunds are handled under applicable law and the policies shown by Link or Stripe for the transaction.

Inspection Tools Are Not Guarantees
PokeLoupe does not guarantee the condition, authenticity, centering, grade, value, print, language, completeness, seller accuracy, shipping terms, return terms, or fulfillment of any card or listing.
Image analysis, centering overlays, corner detection, perspective transforms, price data, seller data, and listing parser output may be inaccurate, out of date, incomplete, or wrong.
You are solely responsible for reviewing the original marketplace listing, photos, seller, price, shipping, taxes, and return policy before buying, bidding, or otherwise acting on a marketplace listing.

Marketplace Clickouts and Affiliate Links
PokeLoupe links to third-party marketplaces such as eBay and TCGPlayer. Any purchase, bid, offer, payment, return, dispute, or account action happens on that third-party marketplace and is governed by that marketplace terms.
Some marketplace links may be affiliate links. PokeLoupe may earn a commission when you click or buy through those links, at no additional cost to you.
Opening a marketplace link does not mean PokeLoupe recommends, verifies, guarantees, or endorses the listing, seller, price, shipping, authenticity, or condition.
You must verify the current auction price, shipping, seller, listing details, and marketplace terms before bidding or buying directly on a marketplace.

Marketplace Data and Third Parties
Auction prices and listing data can change after PokeLoupe captures them. Any auction price shown in PokeLoupe should be treated as a last captured bid, not a guaranteed current price.
PokeLoupe may label data freshness to indicate whether current marketplace details need verification before buying, bidding, making an offer, or relying on any market price.
For declared stale-data incidents, PokeLoupe may offer discretionary Pro account extensions or credits. Credits are not automatic cash refunds and are subject to review unless required by law.
Purchases, bids, offers, payments, shipping, returns, disputes, and marketplace account actions happen on third-party services such as eBay or TCGPlayer and are governed by those services terms.
PokeLoupe is not affiliated with or endorsed by The Pokemon Company, Nintendo, Creatures, Game Freak, eBay, TCGPlayer, PSA, CGC, BGS, or any marketplace or grading company.

No Professional Advice
PokeLoupe provides informational software only. Nothing in the Service is financial, investment, legal, tax, grading, authentication, or professional advice.
You should independently verify all information before making a purchase, bid, sale, grading, or collection decision.

Acceptable Use
You agree not to use the Service for unlawful, abusive, fraudulent, deceptive, or harmful activity.
You agree not to bypass subscription limits, access controls, rate limits, security controls, marketplace policies, or eBay account restrictions.
You agree not to scrape, copy, resell, or redistribute Service data except as permitted by these Terms or by written permission from PokeLoupe.

Saved Review Data
You are responsible for the My Feed cards, favorites, rejected listings, hidden seller rules, notes, and other saved review data you create.
We may remove, limit, suspend, or disable access to content or accounts that create legal, security, marketplace, operational, or abuse risk.

Intellectual Property
PokeLoupe and its original software, design, branding, workflows, and content are owned by PokeLoupe or its licensors.
Pokemon and other third-party names, marks, card images, marketplace names, and grading company names belong to their respective owners.

Disclaimers and Limitation of Liability
The Service is provided as is and as available. To the maximum extent permitted by law, PokeLoupe disclaims warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, PokeLoupe and its officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including losses related to marketplace purchases, marketplace bids, offers, listing inaccuracies, condition disputes, seller behavior, account actions, affiliate links, or reliance on Service information.

Indemnification
You agree to defend, indemnify, and hold PokeLoupe harmless from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your marketplace purchases, marketplace bids or offers, your violation of these Terms, or your violation of third-party rights or marketplace rules.

Governing Law and Disputes
These Terms and disputes arising from them are governed by the laws of the State of South Dakota, without regard to conflict-of-law rules, except to the extent the law where you live requires otherwise.
Any dispute that is not required to be heard elsewhere by applicable consumer law must be brought in a state or federal court located in South Dakota. You and Jones Collectibles LLC consent to those courts' jurisdiction.

Changes and Contact
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of PokeLoupe after changes means you accept the updated Terms.
